VII.2) Information about modifications

VII.2.1) Description of the modifications

Extended duration of the contract together with additional services were necessary pursuant to regulation 72(1)(b) and/or 72(1)(c) of the Public Contracts Regulations 2015 due to unforeseen circumstances that Welsh Government, acting diligently, could not have foreseen (namely the need for continued Project Manager and Supervisor services for ongoing contract administration following the project’s design and build stage during which the contractor was completing outstanding works alongside the requirements to rectify the works’ defects). The additional services that may be required are of the same nature as those provided under the contract; including Project Management support, commercial and technical advice on matters relating to complaints/issues raised by residents, environmental mitigation, boundary treatment including future maintenance liability. Additionally and/or alternatively, a change of contractor for the additional services could not be made due to economical and/or technical reasons and would have caused a significance inconvenience and/or duplication of costs to Welsh Government in instructing a new contractor to undertake such services.

VII.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
