The Council currently own over 22,500 illuminated street assets situated across the city. The nature of the contract is to provide a comprehensive maintenance service for the road, footway and car park lighting, floodlighting, illuminated bus shelters, exterior car park lighting and the illuminated traffic signs and bollards that exist within the boundary of Newport and are the responsibility of the Council to maintain. It is necessary for the Council to have a maintenance contract in place with a suitably qualified contractor in order to comply with our Statutory Duty.

VII.2) Information about modifications
VII.2.1) Description of the modifications
The modification to the contract is to extend the contract period to expire no later than 31st August 2026. No change has been made to the scope or nature of the contract.
VII.2.2) Reasons for modification
Need for additional works, services or supplies by the original contractor/concessionaire
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
NCC have determined the need to extend the existing contract in line with Regulation 72(b) of the Public Contract Regulations 2015 for a period of up to 12 months. A change of contractor cannot be made for economic or technical reasons. In respect of this contract modification, the specification and pricing model for the next contract is not known until the review has been carried out and it is not viable (both financially and operationally for either party) to go out to tender for a short contract term where potentially a large number of employees will TUPE transfer.
This is to allow the Association of Public Sector Excellence (APSE) to carry out an independent review of the Street Lighting Maintenance Contract. It is expected that the APSE review would consider internal contract management, the form and nature of the service provision to ensure any new contract is fit for the future, and any alternative options including collaboration with other contracting authorities.
