A VEAT notice is being issued to ensure transparency of the decision to direct award
Regulation 32 (2) (b) (ii) competition is absent for technical reasons applies. Further details are listed below but as an overview Brightly is the developer and proprietor of the licences and support, therefore competition is absent for technical reasons.
This award allows the Council to continue to use the business-critical asset management platform and further develop its services to meet identified Business need across other Council departments. It is already deployed with external stakeholders who have invested in the product, purchasing software, licences and hardware in good faith in order to integrate processes and work more efficiently and effectively with the Council.

This is a business critical neighbourhood asset management and mobile working system which is integrated with internal and external stakeholders. Future Business requirements include further standardisation across other internal departments and an integral factor in relevant external future contracts as it will form part of the basic specification of requirements.

Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
PCR 2015 Regulation 32 (2) (b) (ii) competition is absent for technical reasons applies.
Brightly is the developer and proprietor of the licences and support, therefore competition is absent for technical reasons.
The current asset management and mobile working system enables the Council's Neighbourhood Services and Transport direct access to service information required by frontline staff regardless of their location.
It also allows our external stakeholders to integrate and work in partnership with the Council, and they have invested in software, training and equipment as well as future proofing services in order to integrate processes and work more efficiently and effectively with the Council.
This award allows the Council to continue to use the business-critical asset management platform and further develop its services to meet identified Business need across other Council departments and enhance engagement with external stakeholders. The requirement to use this platform will be included in all relevant specifications as part of future tendering process. This will be for the duration of the contracts and suppliers are expected to utilise the platform as part of their work with the Council. This also affects the citizens of the Vale of Glamorgan as the system is used to report faults by external customers.
