The procurement falls outside the scope of application of the Directive
Explanation
The contract with HSL Pathology LLP ended on 31st March 2024. A 10 week extension period has been sought to allow sufficient time to undertake a compliant procurement exercise.
The governance arrangements required cannot be undertaken in such a short period of time therefore there is no opportunity to make a compliant direct award for this interim period.
For the reasons outlined above and to ensure continuity of patient care, the Trust has no option but to enter in to an interim agreement without any formal underpinning Framework Agreement.
