Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
A successful pilot in BCUHB is utilising AI to support Pathologists in assessing and quantitating tumour markers when reporting breast cancer biopsies. It is proposed to utilise additional funding awarded from Welsh Government to roll out this development to all Health Boards.
All Health Boards in Wales utilise Ibex for prostate biopsies, and it is also already used in BCUHB for breast biopsies. The infrastructure is in place within NHS Wales to use this system, including an existing Data Protection Impact Assessment. Due to the time constraints of the funding it is not feasible to roll out the use of a different supplier at this time.
For the reasons outlined above and to ensure the success of the project, NHS Wales have no option but to enter in to an agreement without any formal underpinning Framework Agreement for a 12 month period.
