Justification for the award of the contract without prior publication of a contract notice in the Official Journal of the European Union (OJEU)

Other justification for the award of the contract without prior publication of a
contract notice in the OJEU:
k) The contract has as its object services listed in Annex B of Directive 2004/18/EC or in Annex XVII B of Directive 2004/17/EC
l) The contract falls outside the scope of application of the relevant directive.
In addition to the box(es) ticked above please explain in a clear and
comprehensive manner why the award of the contract without prior publication of
a contract notice in the OJEU is lawful, stating in any case the relevant facts,
and, as appropriate, the conclusions of law in accordance with the articles in
the relevant Directive (500 words maximum):
King’s College London procured a lecture capture recording and replay system in 2011 following a successful 2 year pilot and in a Joint Procurement with UCL. The contract was awarded to Echo360 following a rigorous selection and evaluation process in accordance with the ITT. Following this award significant investment has been made to implement and expand the solution into more lecture rooms and theatres: installing the servers and storage, purchasing and installing proprietary Echo360 hardware recorders in nearly 200 lecture theatres and installing software capture in these and other classrooms. The system is integrated within teaching and learning systems and considerable time and effort has been spent on training academic staff to use the system and students how to locate and replay the recordings. The system is integrated into help desk and AV support who maintain the system. To continue to meet the demands of students and staff King’s requires a hybrid approach; that is proven to deliver high quality lecture capture in key areas whilst simultaneously allowing rapid deployment of software capture throughout the whole of the organisation. With more than 5 years invested in the existing system, it is now necessary to extend the existing contract to cover the university's needs for the next 5 years. This represents a further material change to the current contract. Any change to a new system and the consequential replacement of complex integrations with other College systems, as well as the necessary retraining of support staff, academic staff and students would be prohibitive. Echo 360 have proprietary and exclusive rights in the currently installed systems and the technical complexities of either switching to a new platform or of running a hybrid estate involving two or more different vendors have caused King's College London to conclude that the goods and services for this extension can only be provided by a single economic operator.
