The Specialist EOD&S, Exploitation and Countermeasures Project Team, part of the United Kingdom Ministry of Defence (the Authority) have awarded a contract to Roke Manor Research Limited for the in-service support of Detector Special Purpose (DSP34) (the System). The contract is for 15 months and has an estimated value of £888,203.00 (Ex VAT). This contract was placed using the negotiated procedure without prior publication of a contract notice pursuant to Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011 for technical reasons. The VTN was published on 21 October 2024 and the contract was subsequently awarded on 08 January 2025.

ANNEX D3

Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with art. 28 of Directive 2009/81/EC

a)	No tenders or no appropriate tenders in response to:
	restricted procedure negotiated procedure with prior publication of a contract notice competitive dialogue
b)	All tenders submitted in reply to a restricted procedure, negotiated procedure with prior publication of a contract notice or competitive dialogue were irregular or inacceptable. Only those tenderers were included in the negotiations which have satisfied the qualitative selection criteria.

c)	The periods for the restricted procedure and the negotiated procedure with prior publication of a contract notice are incompatible with the urgency resulting from a crisis.

d)	Extreme urgency brought about by events unforeseeable by the contracting authority/entity and in accordance with the strict conditions stated in the relevant Directive.

e)	The works/goods/services can be provided only by a particular tenderer for reasons that are:
