VII.2) Information about modifications
VII.2.1) Description of the modifications
Due to a significant number of variables outside the Contracting Authority’s control, including the outcomes of the Bursary Review, Auger Review and Workforce Strategy for Health and Social Care, the Contracting Authority is modifying the contract by extending the expiry date by 12 months from 01.08.2021 to 31.07.2022. The Contracting Authority is placing reliance upon Regulation 72(1)(c) of the Public Contracts Regulations 2015.
Save for the extended term of 12 months, the services will conform to the original scope and requirement of the initial project/original contracts.
VII.2.2) Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
The Contracting Authority planned to undertake a procurement to award new longer term contracts to commence on 1 August 2021. The contracts are reliant upon Welsh Government funding. However, at the current time there is uncertainty with regards to the longer term funding position for these services. Further, there are other circumstances outside the Contracting Authority’s control which it could not have foreseen at the time the contracts were entered into, namely, the awaited outcomes of the Welsh Government’s NHS Bursary Review, the Auger Review and Workforce Strategy for Health and Social Care in Wales. Accordingly, the Contracting Authority is modifying the contract by extending the expiry date by 12 months from 01.08.2021 to 31.07.2022. The value of the modification per contract does not exceed more than 50% of the original value of the contract concerned. The modification does not alter the overall nature of the contracts.
