IV.1) Description

IV.1.1) Type of procedure

Award of a contract without prior publication of a call for competition

Justification for selected award procedure:

Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the Directive

Explanation

The Covid-19 pandemic created a situation of extreme urgency in terms of risk to public health, which was unforeseeable to the contracting authority. One of the key strategies for dealing with the pandemic and minimising further spread of Covid-19 is contact tracing. The development and configuration of the system, which is the subject matter of this contract, is necessary to enable the Contact Tracing System in Wales to function and be shaped by the management of the pandemic. Therefore, the time limits for the open or restricted procedures or competitive procedures with negotiation cannot be complied with (even using the shortened time limits available). Accordingly, the contracting authority is entitled to make this award under Regulation 32(2)(c) of the Public Contracts Regulations 2015. This notice is a "relevant contract award notice" for the purposes of Regulation 93(3) of the Public Contracts Regulations 2015 and the contracting authority relies on the provisions in Regulation 93(2), (3) and (4) in relation to the applicable limitation period.
