Annex D1 – General procurement
Justification for the award of the contract without prior publication of a contract notice in the Official Journal of the European Union (OJEU)

b) The products involved are manufactured purely for the purpose of research, experiment, study or
development under the conditions stated in the Directive (for supplies only).
c) The works/goods/services can be provided only by a particular tenderer for reasons that are:

d) Extreme urgency brought about by events unforeseeable by the contracting authority and in
accordance with the strict conditions stated in the Directive.

with the strict conditions stated in the Directive.

unacceptable. Only those tenderers were included in the negotiations which have satisfied the qualitative selection criteria.
Other justification for the award of the contract without prior publication of a
contract notice in the OJEU:
k) The contract has as its object services listed in Annex B of Directive 2004/18/EC or in Annex XVII B of Directive 2004/17/EC
l) The contract falls outside the scope of application of the relevant directive.
In addition to the box(es) ticked above please explain in a clear and
comprehensive manner why the award of the contract without prior publication of
a contract notice in the OJEU is lawful, stating in any case the relevant facts,
and, as appropriate, the conclusions of law in accordance with the articles in
the relevant Directive (500 words maximum):
Following a fully advertised restricted procedure (OJEU reference 2013/S 88-149963), commencing on 7.5.2013, the HCA entered into framework agreements on 1.11.2013 with 10 suppliers. Mini-competitions are held for individual appointments or call-offs. The original scope of the framework agreement provided for upwards of 1 000 000 GBP over a 2 year period. It is proposed that the term is increased to 4 years with no other changes in the scope, and value mini-competition process. The modifications described above do not give rise to a new contract that would require a new procurement because one or more of the circumstances in Regulation 72 of the Public Contracts Regulations 2015/Article 72 of Directive 2014/24/EU applies, as follows: The modification is not substantial (Regulation 72(1)(e)). The modification does not render the framework agreement (or its scope) materially different to the original framework — the only modification is to the term with no change to the overall framework value or scope of individual call-offs. The HCA does not consider that the modification would have allowed for admission of other candidates or tenders, or attracted other participants, and does not change the economic balance in favour of the contractor. The HCA publishes this Voluntary Ex-Anti Transparency notice pursuant to Regulation 99 and to fulfill the notification requirements of Regulations 51 and 72(3) of the Public Contract Regulations 2015.
