If any contract documents are accompanied by instructions on safeguarding classified information (e.g. a Security Aspects Letter), the Authority reserves the right to amend the terms of these instructions to reflect any changes in national law or government policy, whether in respect of the applicable protective marking scheme, specific protective markings given, the aspects to which any protective marking applies, or otherwise.

It is considered that this contract can be placed with HORIBA MIRA Ltd using the Non-Competitive Negotiated Procedure without prior publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of UK Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because HORIBA MIRA Ltd is the System Design Authority for the PANAMA ROV for which post design services are required. Any modifications to existing equipment without the technical knowledge of internal design would cause disproportionate cost, risk and technical difficulties. Horiba Mira has the specialised technical expertise, know-how and experience of the system architecture. HORIBA MIRA Ltd additionally holds exclusive rights in relation to the software and some hardware, and no licences have been granted to any third party.
