In 2016, the Council procured a new Learning Management System (LMS) for staff. An open tender process was undertaken and workforce development evolve software was procured from Comenius Talent Management to deliver the following:
— learning management and virtual learning,
— performance management,
— talent management,
— the solution is accessible by all staff across the Council and is interoperable with the Council's SAP system in order to automatically update staff HR data.
This VEAT notice is to notify the market that the Council will be extending the contract for an additional 3 years Evolve Licencing, support and maintenance from Comenius Talent Management.
Comenius Talent Management own the IPR for the evolve solution and are the sole provider of the licences and support required to continue to use the solution the Council has implemented.

Explanation:
The Council are not looking to procure a new system but are to continue with the use of the existing Evolve solution.
Comenius Talent Management own the IPR for the Evolve solution and are the sole provider of the licences and support required to continue to use the solution the Council has implemented.
There is an absence of competition for Technical Reasons as Comenius are the sole provider of licences and support for the existing implemented system.
The licences, support and maintenance can only be provided by a particular operator due to the protection of exclusive rights including Intellectual property rights.
