II.2.4) Description of the procurement
The contract will result in Torbay Council transferring the Torbay Young Carers Service and the Torbay Youth Service to the Torbay Youth Trust.
Under the contract in relation to the Young Carers Service the Youth Trust will deliver against the statutory duties of the local authority as outlined by the following legislation:
— the Children and Families Act 2014,
— the Care Act 2014,
— the Care and Support (eligibility criteria) Regulations 2014,
— the Young Carers Regulations 2015,
— the Care and Support (assessment) Regulations 2014.
All delivery will meet the responsibilities outlined in the legislation and be delivered in accordance with best practice guidance and Working Together 2018.
Under the contract in relation to the Youth Service the Torbay Youth Trust will provide one to one and group intervention to vulnerable children and young people in need of support at the level of early help as defined in the Torbay safeguarding children board children’s services threshold document.
The Youth Service will also provide targeted support through the delivery of the children in Care Council and the LGBTQ group and deliver support and interventions in relation to sexual health and healthy relationships for young people between the ages of 13 and 19 years.
Both the Youth Service and Young Carers Service will work with key partner agencies to identify, develop and deliver responses and interventions to meet the needs of children and young people in Torbay and be part of key delivery processes and pathways including but not limited to safeguarding and early help pathways, the targeted help panel and team around the family process.

Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
Work has been taking place since 2013 to create a Youth Offer with the aim to develop a new model of delivery that meets the requirements of the local authority, delivers against long term strategies relating to poverty, attainment and employment and health whilst exploring additional funding streams and building revenue capacity.
Following due consideration of all possible models of delivery, including and alliance, association, community interest company or a trust; it was agreed through the local authority star chambers process to enter into an agreement for the delivery of a Youth Offer with the Torbay Youth Trust.
A key advantage of this is the ability of the Torbay Youth Trust to bid for additional grants and other income, not accessible to the Local Authority. The Youth Trust is in a position to do this both as individual provider and also in collaboration with other organisations. This will result in more opportunities to creatively support young people in Torbay to be happy, healthy, safe and to achieve, than would be available if the services were delivered solely by the local authority.
Due to the Torbay Youth Trust being embedded within the Torbay children’s and family’s partnership and having a broad range of expertise on the board to inform development, it is felt they are in the most appropriate position to take on the delivery of these services both in terms of creative delivery and to meet the statutory and strategic aims of the local authority.
