Sonars. Flight recorders. The Department for Transport are looking for a supplier to design, build and deliver 2 fully operational, tested and documented Towed Flight Recorder Underwater Locator Beacon Systems (consisting of an Acquisition and Recording System and a Signal Processing System) plus ancillary tools and parts. The systems will be used to assist the Air Accidents Investigations Branch (AAIB) in the underwater searching and localisation of aircraft flight recorders following a crash in water.

Total quantity or scopeThe AAIB requires a new towed detection system that is intended to replace the current AAIB system that was designed and built in the mid—1980s, taking full advantage of any advances made in underwater acoustic technology and equipment in the intervening years. Improved performance, reliability, ease of maintenance and access to spare parts, portability and ease of deployment are all essential requirements of the new system for it to be of use in the challenging task of searching for Underwater Locator Beacons in the harsh offshore environment. The supplier is to deliver the services over a 12-month period with an option to extend for up to for 12 months. |

The Authority will apply all the offences listed in Article 45(1) of Directive 2004/18/EC of the European Parliament and of the Council (implemented as Regulation 23(1) of the Public Contract Regulations (PCR) 2006 in the UK) and all of the professional misconducts listed at Article 45(2) of Directive 2004/18/EC of the European Parliament and of the Council (see also Regulation 23(2) in the PCR 2006) to the decision of whether a Candidate is eligible to be invited to tender.

Lodging of appeals
The DfT will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. Applicants who are unsuccessful shall be informed by the DfT as soon as possible after the decision has been made as to the reasons why the Applicant was unsuccessful. If an appeal regarding the award of the contract has not been successfully resolved, The Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take legal action. Any such action must be brought within the applicable limitation period. Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may, depending on the circumstances, award damages, make a declaration of ineffectiveness, order the Authority to pay a fine, and/or order that the duration of the contract be shortened. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the contract is entered into.
