The Merlin Project Team, part of the UK Ministry of Defence, has awarded a contract to Selex ES Ltd to upgrade the extant pan-platform ground based programming software to support an additional platform (Merlin MK4/4A). Selex ES Ltd will also be required under the contract to upgrade the Pre-Flight Messages test rig to represent the MK4/4A configuration, upgrade the system training documentation and delivery of a training event. It is considered that the contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16 (1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for reasons connected with the protection of exclusive rights. This is because Selex ES Ltd has exclusive intellectual property in the Mission Dependent Data Generator (MDGG) Pre Flight Message Generator (PFMG) software. The work required under the contract requires modifications to be made to the software which can only lawfully be carried out by Selex ES Ltd.
