Abstract

Highways network infrastructure maintenance and management – this will include inspections, programmes of works and asset maintenance, including winter services. Typical activities may include:

— responsive maintenance,

— public consultation,

— planned structural maintenance,

— provision and upkeep of properties,

— provision of advice on maintenance, asset management, condition surveys and analysis,

— maintaining asset databases,

— liaison with the Council’s Street Lighting PFI service provider,

— improving delivery of NCC’s local transport plan integrated transport improvement services, including transport services,

— forward transport planning,

— traffic signalisation and intelligent transport services – consultancy and delivery, the maintenance and improvement of traffic control and information systems and intelligent transport systems,

— provision of specialist transport services for home to school special educational need and adult and child social care.

Typically:

— bidding support for growth agenda funds,

— provide and support feasibility studies,

— provide other advice on construction related matters,

— project management consultation and support for NCC in development of integrated transport and growth projects and other identified civil engineering projects,

— traffic, transportation and environmental studies and modelling of impact and feasibility,

— transport surveys, data collection, analysis and management including assets and traffic,

— carry out the design and construction of capital projects for Waste Disposal Authority, surface works in schools and other highways related projects,

— design and supervision of integrated transport and growth projects and other civil engineering projects as required by NCC,

— design, construction and implementation of non-civil engineering local transport plan projects as required by NCC,

— assistance with public consultation and engagement,

— geotechnical and topographical surveys and advice,

— liaison with the street lighting PFI service provider,

— collating and analysing relevant data from the delivery of activities with a view to providing proactive suggestions as to how the delivery of NCC’s local transport plan service could be improved to better meet its objectives,

— general professional advice and support as required including development control, traffic management, model contract document development and maintenance, travel plans, asset management plan, road safety, transport planning, public transport, development of the growth agenda, financial and budgetary control, website maintenance,

— traffic control and information systems including maintenance and improvement of the traffic control centre, traffic signal maintenance and intelligent transport systems plus CCTV,

— transport planning; provision of specialist fleet including drivers and passengers assistants for home to school special educational needs and adult and child social care to complement taxis provided by the external market (provision of coach transport and taxis is not included),

— travel planning and associated services for home to school transport and social care transport.

County structures maintenance and regulatory functions – a combination of consultancy advice and the delivery of highway and structure improvement works and services. Typical activities may include:

— bridge and structures management,

— inspections and assessments,

— structural advice relating to fire safety and safety of places of sport act,

— structural design check and advice,

Section IV: Procedure

IV.1) Description

IV.1.1) Type of procedure

Award of a contract without prior publication of a call for competition

Justification for selected award procedure:

The procurement falls outside the scope of application of the Directive

Explanation:

On 14.5.2019 the Government confirmed that subject to passing secondary legislation NCC and 8 local Councils across Northamptonshire would be replaced by 2 unitary Councils. This is to take place on 1.4.2021. NCC’s highways services contract will expire in March 2020. The proposed changes and consultation and the Ministerial announcement confirming its outcome have made the re-procurement of these services non-feasible.

Any change of contractor would not be feasible for economic reasons. NCC has decided to enter into a short contract with the existing provider for an initial period of 16 months with the option to extend for a period of up to 9 months, giving a maximum total of 25 months. This will give sufficient time for the new shadow council's to decide on a strategy for highway services for the new unitary Councils and embark on an OJEU advertised procurement procedure in due course.

Actual value of the existing contract is anticipated to be 580 000 000 GBP. Envisaged value of the short contract is 92 000 000 GBP-120 000 000 GBP, equivalent to a 20,6 % increase. This is within the 50 % increase threshold specified in Regulation 72(1)(b) and (1)(c) of the Regulations.

Adding 25 months to the 12-year term is not substantial for the purposes of Reg.72(1)(e).

The short contract is required as a result of the enforced restructuring of the authority.
