Cardiff and Vale University Health Board (CVUHB) Nephrology and Transplant Directorate current manage the provision for satellite dialysis units across six satellite units in South East Wales. These units provide maintenance haemodialysis for adult patients with chronic established renal failure for which these units offer patients vast health and physiological benefits. The units are strategically located within 30 minutes of patient’s home with the aim of providing equitable access is met by locating satellite units in the community, allowing the provision of accessible renal services.

II.2.4) Description of the procurement
The Merthyr Renal Dialysis contract was awarded in 2014 as a standalone service contract to the South East Wales Renal Dialysis contract due to the urgency to replace the existing unit in Merthyr and support the patient population to accommodate the increased demand on the service. However, the unit has exceeded the growth predictions year on year and demand for the Merthyr unit has exponentially increased where there is now limited capacity in the existing 27 stations to provide additional patient haemodialysis sessions and presents the urgent need to increase the number of patient stations.

IV.1) Description
IV.1.1) Type of procedure

Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
Based on the projected estimates it is considered necessary to expand up to 33 dialysis stations over the next four years to ensure continued equitable patient care. To secure the expansion and avoid paying significantly higher costs, it is proposed that the contract for Merthyr is extended for a further two years and 29 days to align with the South East Satellite Renal Dialysis agreement. This not only offers a sustainable commercial model but also long term benefits where the renewal of both renal contracts under CVUHB management are retendered under one aggregated offering to the market with the aim of delivering significant efficiencies and greater value for money immediately and on contract renewal.
It should be noted that the current contract includes the provision for growth up to 30 patient stations, however, increasing the patient stations to 33 and providing an extension to March 2026 is outside of the modifications outlined within the existing contract. Due to this, the Health Board is issuing this VEAT notice for the modification and extension and applying a 10 day standstill period prior to awarding the contract.

Aggrieved parties who have been harmed or are at risk of harm by breach of the procurement rules have the right to take action in the High Court (England and Wales). Any such action is subject to strict time limits in accordance with the Public Contracts 2015 (Amendments).
