The contract is for a period of three months, commencing in March 2023. The successful applicant will have a strong track record in this type of work. This contract will have three distinct phases 1. Research into provision of and demand for an educational resource (March 2023) 2. Development of an educational resource (April- June 2023) 3. Providing training to staff to share and deliver resource (June 2023) Tender to the maximum value of 10,000 pounds exclusive of VAT 1.2 Background to the Elan Links: People, Nature & Water Landscape Partnership Scheme The Elan Valley is a special place with a unique landscape, story and history. Elan Valley’s human history goes back over 4000 years, though it is most often noted for the construction of a series of dams and reservoirs in the late 19th century to bring clean water to Birmingham. Elan Links is a Heritage Lottery supported scheme which aims to secure the heritage of the whole estate and boost the opportunities available in the Elan Valley for the future. In total 26 projects will be delivered between 2018 and 2023 under the following themes: Celebrating heritage: protecting and historic sites, improving visitors access and archiving people’s histories and stories Enjoying Elan: improving opportunities for new and existing visitors Experience and education: offering voluntary, training and education opportunities Enhancing nature and wildlife: protecting natural habitats and traditional farming practices Nearly £3.4million will be invested in the Elan Valley area to safeguard heritage and increase the opportunities for visitors. 1.2 Background to the Elan Links: People, Nature & Water Landscape Partnership Scheme

The Elan Valley is a special place with a unique landscape, story and history. Elan Valley’s human history goes back over 4000 years, though it is most often noted for the construction of a series of dams and reservoirs in the late 19th century to bring clean water to Birmingham. 2.2.1 Research into provision of and demand for an educational resource

There are three deliverables in this phase:

To undertake research into the rollout and content of the new curriculum, in order to identify where there are opportunities for external organisations to offer resources which compliment the curriculum.

To identify which age groups and subjects would be most relevant to the context of Elan Valley.

To identify what form the resource should take to secure maximum uptake

Development of an educational resource

There are two deliverables in this phase

To undertake research around aspects of Elan Valley’s history, ecology and geography that are relevant to the new curriculum, supported by the Elan Links team.

To create an educational resource suitable for secondary age students which relates to three key themes; Water as Resource, Elan’s Natural Landscape and Elan’s Human Heritage. This should be a physical and/or digital resource which teachers can use and adapt directly and one that Elan Links staff can deliver in schools or in Elan Valley itself.

2.2.2 Providing training to staff to share and deliver resource

There are two deliverables in this phase:

To provide a half day training session for Elan Links staff to support them in recruiting schools and delivering the educational resource.

To also provide phone and email support for staff in relation to the above.

3. Price and Payment Schedule

The total cost for delivery of this work is to be no more than 10,000 pounds(excluding VAT).

The schedule for payment will be agreed at the inception meeting. Phased payments are anticipated.

Award Criteria

The appointed consultant will:

Show that they fully understand our requirements in letting this contract, and are prepared to work with us in a flexible way over the contract period to best meet our needs;

Have a strong understanding of both the new and old national curriculum framework and in particular Key Stage 4. They will be able to demonstrate that the personnel who will be involved have appropriate skills and relevant background knowledge.

Have experience in researching and developing educational resources, which can be easily understood and delivered in a classroom setting by teachers and/or or Elan Links staff.

Show that they will be able to work effectively and in a creative way with the scheme team and the wider partnership, and where appropriate will take an innovative approach to the creation of a resource;

Be able to justify costs and provide demonstrable value for money. The appointed consultant will need also to have:

• Excellent presentation, written and verbal communication skills

• Robust management and project management arrangements

• Commitment to equalities

• The ability to take initiative and work independently

• The ability to work with a variety of people

• A willingness to travel within the scheme area and adopt flexible working patterns

6.5 Insurance

Elan Valley Trust would expect appropriate company insurance that covered public liability, employee liability and professional indemnity insurance with a guide figure of £5M cover.

6.6 Intellectual Property

The intellectual property rights (including copyright and design) of all work, documentation, data, and materials and of any copies thereof (“Materials”) produced for the scheme and/or partnership by or on behalf of the appointed consultant will vest in Elan Links and the delivery partners and the appointed consultant agrees and accepts that licences shall be granted to use the same to any supporting partners for use for non-commercial purposes. The appointed consultant shall not make or permit others to make any copies of materials without Elan Valley Trust’s consent. Copyrights attached to the source data must be strictly adhered to. The appointed consultant shall maintain adequate security measures during the term of the contract to safeguard materials from unauthorised access use or copying, and shall notify Elan Valley Trust immediately if the consultant becomes aware of any unauthorised access to, use or copying of any materials by any person.

6.7 Right to cancel or vary the tender

Elan Valley Trust reserves the right:

i. to amend, clarify, add to or withdraw all or any part of the Tender Invitation at any time during the process;

ii. to vary any timetable or deadlines set out in the Tender Invitation;

iii. not to conclude a contract for some or all of the goods and/or services (as applicable) for which Tenders are invited; and

iv. to cancel all or part of the Tender Invitation at any stage at any time.

The Potential Provider accepts and acknowledges that by issuing the Tender document, Elan Valley Trust is not bound to accept a Tender or obliged to conclude a contract with the Potential Provider at all.

6.8 Contract awarding

The Potential Provider that achieves the highest total score will be awarded the Contract.

If two or more Potential Providers obtain the highest total score, the Potential Provider with the highest score for the price element will be deemed the winner and awarded the Contract.

If Elan Valley Trust receives only one Tender in relation to this brief, the Potential Provider will be awarded the Contract provided that they meet the Minimum Total Score of 65.

6.9 Contract Termination

6.9.1 Contract Break Clause

The contract for the delivery of the Services will reference Phases 1 and 2 and will contain a right for Elan Valley Trust to terminate the contract on written notice at the end of Phase 1 (research and development) if, in the reasonable opinion of Elan Valley Trust, the Potential Provider has not performed the Services required and delivered the deliverables in Phase 1 to Elan Valley Trust’s reasonable satisfaction.

6.9.2 Termination of contract by contractor

If you decide that you are unable to meet your obligations under this Contract you must immediately write to us and explain the reasons giving us at least one month notice of your intent to do so.

6.9.3 Termination of contract by Elan Valley Trust

Any of the following conditions is a material breach which will automatically and immediately enable us to terminate this Contract:

a) you commit any gross misconduct affecting the business of Elan Valley Trust, Elan Links or any of the Scheme Partners;

b) you commit any serious or repeated breach or non-observance of any of the provisions of this agreement or refuse or neglect to comply with any reasonable and lawful directions of Elan Valley Trust;

c) you are convicted of any criminal offence (other than an offence under any road traffic legislation in the United Kingdom or elsewhere for which a fine or non-custodial penalty is imposed);

d) you are in the reasonable opinion of Elan Valley Trust negligent or incompetent in the performance of the Services;

e) you are declared bankrupt or make any arrangement with or for the benefit of your creditors or have a county court administration order made against him under the County Court Act 1984;

f) you are incapacitated (including by reason of illness or accident) from providing the Services for an aggregate period of 5 days in any [3-week] consecutive period;

g) commits any fraud or dishonesty or acts in any manner which in the opinion of Elan Valley Trust, Elan Links or any of the Scheme Partners brings or is likely to bring Elan Valley Trust, Elan Links or any of the Scheme Partners into disrepute or is materially adverse to the interests of Elan Valley Trust, Elan Links or any of the Scheme Partners;

h) commits any breach of any of Elan Valley Trust, Elan Links or any of the Scheme Partners relevant policies and procedures; or

i) commits any offence under the Bribery Act 2010.

j) you assign any of your obligations under this Contract without our prior written consent;

k) you sell or transfer your business to any other organisation or organisations without informing us first; or

l) you cease to trade for any reason.
