Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
BEIS is awarding to the chartered trading standards institute in accordance with Regulation 32 of the Public Contracts Regulations — negotiated procedure without prior publication — (2) b) (ii) competition is absent for technical reasons.
The intended contract is for the provision of training for Trading Standards Officers in the technical areas of product safety and legal metrology. It is proposed to award the contract to the chartered trading standards institute (CTSI) as a direct award as there is no other organisation with the relevant experience and expertise in regulatory matters, relevant networks (in particular in sourcing training providers) and trust throughout the trading standards community. In detail:
Confidence: it is vital that the training is delivered through a trusted entity. Without this, we would risk local authority officers not engaging with the package and a lack of confidence in the information being published. The chartered trading standards institute (CTSI) have many years' experience delivering products for local authority officers. They are seen as a reliable source of information for product safety and legal metrology and a key partner for local authorities to engage with. The website CTSI would use to publish the resources is already hosted by them and mirrors their ‘Business Companion’ offering. If another provider was used, the website would be unknown and therefore seen as less reliable and not a useful tool to enable local regulatory delivery.
Expertise: in addition to their experience working with trading standards officers, CTSI have the expertise in the required regulatory matters. The development of tailored training workshops would be impossible for an organisation without this background, as it needs a regulatory expert with a full knowledge of trading standards to survey the current training needs and devise a suitable programme.
Networks: CTSI have the necessary networks to deliver the training. This also applies to sourcing trainers and content writers for the online learning section of the website, which would not be able to be carried out effectively by an organisation without these networks. Through their networks, CTSI are able to advertise the offered support and encourage local authorities to take up the offer. It is very important to have an organisation external to Government able to do this, so as to encourage engagement. Furthermore, they have access to the networks to assess the current landscape and evaluate training needs and to work with local authorities on product safety campaigns.
