ANNEX D3

Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with art. 28 of Directive 2009/81/EC

a)	No tenders or no appropriate tenders in response to:
	restricted procedure negotiated procedure with prior publication of a contract notice competitive dialogue
b)	All tenders submitted in reply to a restricted procedure, negotiated procedure with prior publication of a contract notice or competitive dialogue were irregular or inacceptable. Only those tenderers were included in the negotiations which have satisfied the qualitative selection criteria.

c)	The periods for the restricted procedure and the negotiated procedure with prior publication of a contract notice are incompatible with the urgency resulting from a crisis.

d)	Extreme urgency brought about by events unforeseeable by the contracting authority/entity and in accordance with the strict conditions stated in the relevant Directive.

e)	The works/goods/services can be provided only by a particular tenderer for reasons that are:
	technical connected with the protection of exclusive rights.

Other justification for the award of the contract without prior publication of a contract notice in the OJEU:
The contract has as its object services listed in Annex II B to the Directive. The contract falls outside the scope of application of the Directive.
In addition to the box(es) ticked above please explain in a clear and comprehensive manner why the award of the contract without prior publication of a contract notice in the OJEU is lawful, stating in any case the relevant facts, and, as appropriate, the conclusions of law in accordance with the articles in the relevant Directive (500 words maximum):
The Ministry of Defence (the Authority) has awarded a Single Source Contract with Ultra PCS Limited for the Repair and Refurbishment of Optical Electrical and Electronic Components and Associated Assemblies. It is considered that this contract placement can be placed using the Negotiated Procedure Without Prior Publication pursuant to Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for technical reasons because; a. Ultra Precision Control Systems, who are the original equipment manufacturer and the Design Authority hold all design drawings/information, technical specifications and technical expertise and Special Tooling and Test Equipment required. b. Due to the interoperability requirements of the equipment, the repair and refurbishment cannot be undertaken without access to the OEM and Design Authority technical documentation, which is not available to third parties, no other party at this current time would be able to support this requirement. This notice is not a request for expressions of interest so please do not apply to be invited to tender. This notice advises that UK Ministry of Defence has awarded a single source 7 year framework agreement with the named supplier and this notice is published for reasons of transparency only. Please note, Babcock Land Defence Limited is acting as agent on behalf of the Ministry of Defence, in the first instance interested parties may contact Babcock with queries relating to this procurement.
