Previously the Council sourced telecare equipment via the Scotland Excel framework agreement for Technology Enabled Care ref: 3117, however, that framework agreement ended and there has been a delay to the award of the replacement Scotland Excel framework agreement (Supply and Delivery of Technology Enabled Care Goods framework ref: 0622). A waiver has been approved to facilitate ongoing access to the three incumbent suppliers for a short term period in the interim.

IV.1.1) Type of procedure

Award of a contract without prior publication of a call for competition

Justification for selected award procedure:

The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons

Explanation

This contract falls within the category of contracts covered by the Public Contracts (Scotland) Regulations 2015 and is being awarded in accordance with the process set out in Regulation 33, in particular Regulation 33 (1) section (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons – (ii)competition is absent for technical reasons; there is a limited supply market. This short term interim arrangement will allow the continuity of supply for compatibility purposes and allow the service to continue to be delivered. Due to the nature of the requirement, this award is essential to continue the service for vulnerable people within Edinburgh.
