II.2.4) Description of the procurement
APHA require service, maintenance and calibration of a remote temperature and environmental monitoring system. The Services include: <br/><br/>- Standard and premium levels of monitoring and support: 24/7 (365 days a year), sensor alerts (by text or email, plus alert calling option if required) and helpdesk / support service. <br/><br/>- Calibration: Provision of on-site UKAS (ISO 17025) calibration service with certificates of calibration provided. <br/><br/>- Cloud Platform: Access to secure online software and data storage. <br/><br/>- Hardware: Any replacements needed to maintain performance. Remote diagnosis of any issues (with self-swap or engineer visit if needed). <br/><br/>- Maintenance: Ongoing system maintenance and software upgrades (+ annual preventative maintenance health check). <br/><br/>This contract covers the period 01/07/2024 to 31/03/2027 (with an extension of up to 24-months, to 31/03/2029). The value shown on this notice is approximate for the total period (including extension).<br/><br/>A voluntary ex ante transparency (VEAT) notice (reference 2024/S 000-008725) was published on 18/03/2024 for this requirement.

The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights
Explanation
Based on the information detailed below, and publication of a VEAT Notice on 18/03/2024, it was concluded that Checkit Europe Ltd is the only supplier able to meet APHA's requirements.<br/><br/>Checkit Europe Ltd own the IPR to the equipment and software provided to / accessed by APHA under the current contract. Further investigation has confirmed that there are no re-sellers of CAM+ Equipment providing related temperature monitoring services (so a restricted competition amongst current distributors would not be a valid route to market). <br/><br/>To enable connection between the Equipment and Supplier software, a new supplier would have to install their own Equipment to APHA laboratories, which links to their own software package. This would involve replacing approximately 824 items of Equipment across the APHA estate.<br/><br/>To unnecessarily remove and replace functioning Equipment would not only be a considerable expense and have a negative sustainability impact but would also, critically, have a significant and unacceptably disruptive effect on business-as-usual APHA scientific activities across the whole laboratory estate. (This would include containment facilities that can only be accessed by maintenance personnel during planned shutdowns, which only happen once per year.)
