Milton Keynes City Council (the "Council") is bringing to the market a significant residential development opportunity and is seeking to procure a development partner to work with the Council to bring forward the Tickford Fields Farm Site, Newport Pagnell,(the "Site") in its entirety and deliver a high quality scheme. The Site benefits from a resolution to grant outline planning permission (all matters reserved except access) for the demolition of the existing farm buildings on the Site and the development of up to 930 dwellings (including affordable dwellings), primary school, local centre, open space, sports pitches, play areas, pavilion/wellbeing centre and other associated works. The Council is looking to appoint a development partner who is committed to working with the Council in a true partnership style to design and deliver a viable and attractive proposal.

Procurement of a development partner to deliver the Project at Tickford Fields Farm, Newport Pagnell. The Development Agreement will be for a term of 12 years, with an option for the Authority to extend the term for further period or period(s), the total of any such extensions not to exceed a maximum 3 years in total (i.e. making the maximum contract length 15 years). The Development Period itself may not exceed 10 years.

The Public Contracts Regulations 2015 apply to this procurement (the Regulations). The Council is using the Restricted procedure in accordance with Regulation 28 of the Regulations.The Council estimates that the gross development value of the opportunity is between £200,000,000 and £300,000,000 (GBP). This estimate is reflective of current values and does not allow for any inflation. The Council reserves the right to withdraw from or discontinue the procurement at any stage of the procurement process which shall includethe right to not award the Development Agreement or award only part of the opportunity described in this Contract Notice. The Council will incorporate a minimum 10 calendar day standstill period at the point information on the award of the Development Agreement is communicated to tenderers. Applicants who are unsuccessful shall be informed by the Council as soon as possible after the decision has been made as to the reasons why the Applicant was unsuccessful. If any clarification regarding the award of the Development Agreement has not been successfully resolved, The Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take legal action. Any such action must be brought within the applicable limitation period. Where a contract has not been entered into, the Court may order the setting aside of the award decision or order theCouncil to amend any document and may award damages. If a contract has been entered into the Court may, depending on the circumstances, award damages, make a declaration ofineffectiveness, order the Council to pay a fine, and/or order that the duration of the contract be shortened. The purpose of the standstill period referred to above is to allow theparties to apply to the Courts to set aside the award decision before the Development Agreement is entered into.
