Day opportunities for older people continues encompass a wide range of activities for older people that involve supporting people to age well and is seen as a key support for unpaid carers achieving a short break from caring, preventing crisis and allowing them to continue in their caring role, and maintain the cared for person at home for as long as possible. The aim of day opportunities is to improve quality of life for the frailest, and for people with dementia, by ensuring they remain or become active citizens who are socially engaged, and provide that crucial support for unpaid carers. The provider must be Care Inspectorate registered and have access to a suitable building as an integral part of the service.

The procurement involves the establishment of a framework agreement
Justification for any framework agreement duration exceeding 4 years: The supply market is historically stable with no new entrants for the past 10 years. To ensure stability for the third sector providers, the 8-year time framework is justified. This procurement also recognises the Light Touch Regime, which recognises best practice for the procurement of care and support services.

Tenderers are also asked to confirm that they will pay staff that are involved in the delivery of services under the contract, at least the real Living Wage.
Tenderers who do not pass these questions will not be subject to Commercial Analysis. As a result the tender will not be considered further.
Bidders must complete the SPD (Scotland) to demonstrate adherence to the Exclusion and Selection Criteria for this procurement.

An economic operator that suffers or risks suffering loss or damage attributable to a breach of duty under Public Contracts (Scotland) Regulations 2015 may bring proceedings in the Sheriff Court or Court of Session. A claim for an ineffectiveness order must be made within 30 days of the Contract Award Notice being published in the Find a Tender Service or within 30 days of the date those who expressed an interest in or otherwise bid for the contract were informed of the conclusion of the contract or in any other case within 6 months from the date on which the contract was entered into.
