The contract, the award of which is the subject of this contract award notice, is a service concession contract subject to Regulation (EC) No 1370/2007 of the European Parliament and of the Council of 23.10.2007 on public passenger transport services by rail and by road and repealing Council Regulations (EEC) Nos 1191/69 and 1107/70. Accordingly, and without prejudice to the application of Article 3 of Directive 2004/18/EC of the European Parliament and of the Council of 31.3.2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts (the ‘Directive’), its award is not subject to the Directive and the publication of this notice in the Official Journal of the EU is entirely voluntary.
