II.2.4) Description of the procurement
Operational infrastructure, part of the UK MOD, intends to place a new contract with HDT Global Europe Ltd.

5 years + 5 x 1 year options.
4 900 000 GBP.
Providing in-service support, with an option for additional equipment, for MOD’s existing Headquarters working environment (HQWE) capability as provided by Deployable Rapid Assembly Shelters (DRASh). DRASh are temporary structures providing sheltered environments for deployable HQWEs. This contract will be placed with HDT Global Europe Ltd using the negotiated procedure without prior publication of a contract notice under Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulation 2011) for technical reasons:
HDT Global Europe Ltd are the sole suppliers and IPR holders of DRASh to the UK. Another supplier wouldn’t have the necessary technical documentation or know-how to have a technical understanding of the equipment or support the safety case for repair and modification.

Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
It is considered that this contract can be placed with HDT Global Europe Ltd using the negotiated procedure without prior publication of a contract notice under Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulation 2011) for technical reasons. This is for the following reasons:
HDT Global Europe Ltd are the sole suppliers and IPR holders of DRASh to the UK. An alternative supplier would not have access to the necessary technical documentation or know-how to have a sufficient technical understanding of the equipment and to be able to understand or support the safety case for repairs and modifications.
