NHS Wales Shared Services Partnership-Procurement Services (hosted by Velindre University NHS Trust) and operating on behalf of Cardiff and Vale University Health Board (‘CAVUHB’) is placing this voluntary transparency notice to alert economic operators of its intention to award a contract to Oracle Corporation UK Ltd for Oracle database licensing for its Patient Administration System (PMS).

To provide Oracle licensing for CAVUHB Patient Administration System for 1 years from May 2024 to April 2025. Oracle has been the chosen database for PMS for over two decades and as the requirements for the Health Board has expanded, so has the Oracle features to meet the requirements and the expansion to the Database has grown during the past 2 decades.
The licensing allows for the continued use of the Oracle products that make up PMS.

Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
NHS Wales Shared Services Partnership-Procurement Services (hosted by Velindre University NHS Trust) and operating on behalf of Cardiff and Vale University Health Board (‘CAVUHB’) is seeking to award contract to Oracle Corporation UK Ltd under Public Contracts Regulations 2015 Regulation 32 (2) (b): (ii) competition is absent for technical reasons, (iii) the protection of exclusive rights, including intellectual property rights.
Oracle has been the chosen database for PMS for over two decades through All Wales contracts and as the requirements for the Health Board has expanded, so has the Oracle features to meet the requirements and the expansion to the Database has grown during the past 2 decades. The licensing allows for the continued use of the Oracle products that make up PMS which are not covered in the All Wales contract, however, the Health Board cannot operate a separate system for this element of the overall requirement.
