Short description of the contract or purchase(s)

The Isle of Anglesey County Council Highways in collaboration with Horizon Nuclear Power wish to set up a Framework Contract with suitably experienced Highway Construction and Civil Engineering Contractors. The Framework shall be used to deliver new highways, highways improvements, other associated civil works and any other related works required by IoACC and Horizon.

The Framework will be divided into 3 lots, with expected value range being; Works less than GBP1M in value; GBP1M and GBP5M in value and Works over GBP5M in value.

Contractors will only be able to tender for 2 out of the 3 lots, and by introducing a range of values the intention is to make tender opportunities comparatively accessible to a wider range of business sizes.

It is envisaged that approx. 3-5 contractors will be appointed to each lot, following the tendering process conclusion towards the end of this year. Successful contractors on each Lot will then be invited to tender at call off stage. All further information will come through the Sell2Wales portal so it is important that all Contractors are registered on Sell2Wales.

1. Disclaimer

Applicants are responsible for obtaining the information which they consider necessary in connection with the Tender and must form their own judgement on its validity and suitability. The subject matter of this PQQ shall only have a contractual effect when it is incorporated into the express terms of an executed contract.

This is a Pre-Qualification Questionnaire only. The Isle of Anglesey County Council is not obliged to accept any submissions or enter into any contract pursuant to the Tender and reserves the right in its absolute discretion to withdraw from or terminate the process set out in this PQQ at any time, for any reason and without prior notice to the Applicants and at its sole discretion re-invite proposals on the same or any alternative basis. Nothing in this PQQ is to be construed as implying commitment by the Isle of Anglesey County Council that it will award a contract. Any expenditure, work or effort undertaken is accordingly a matter solely for the commercial judgement of the Applicants.

The Isle of Anglesey County Council does not make any representations or warranties (express or implied) or accept any liability or responsibility (other than in respect of fraudulent misrepresentation) in relation to the adequacy, accuracy, reasonableness or completeness of the information in this PQQ or any part of it (including but not limited to, any loss or damage arising as a result of reliance by Applicants on the information or any part of it).

2. Changes to the PQQ response

Applicants must confirm whether there has been any material change in relation to the information submitted at the PQQ stage. Where some material change has occurred, the Applicant must provide updated equivalent information to that requested in the PQQ.

The Isle of Anglesey County Council reserves the right to disqualify any Applicant where there is a material change to any aspect of its response to the PQQ if such Applicant has failed to notify the Isle of Anglesey County Council of such change or, having notified the Isle of Anglesey County Council, Isle of Anglesey County Council considers the effect of the change is such that the basis of the evaluation for the purpose of selecting potential bidders, the Applicant would not qualify.

The Contractor shall ensure that all contracts with Subcontractors and Suppliers which the Contractor intends to procure following the Award date, and which the Contractor has not, before the date of this Contract, already planned to award to a particular Subcontractor or Supplier, are advertised through the Sell2Wales portal (www.sell2wales.co.uk) and awarded following a fair, open, transparent and competitive process proportionate to the nature and value of the contract.
