Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation
32(2(b)) Where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons: - (ii) competition is absent for technical reasons but where no reasonable alternative or substitute exists, and absence of competition is not as a result of an artificial narrowing down of the parameters of the procurement.
There are no other registered childcare providers operating within this targeted area that can meet the needs of Flying Start. Within this radius there is one Flying Start setting, and we cannot increase the numbers we contract with this setting due to CIW registration. If we need to factor in a new build, it’s uncertain as the current capital programme runs to March 31st, 2025. We would also need to consider the length of time it takes to secure a new provider and CIW registrations.
