IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
Weqas (Welsh External Quality Assurance Service) have within their equipment fleet a Tandem MS (LC-MS/MS) which was purchased in late 2016.
Waters are the manufacturer of this equipment which has only been on the market since 2016 and therefore, knowledge of the equipment and software in maintaining this kit is limited amongst third party suppliers at this current time.
Engaging with the market, it has been determined that whilst there are some third party suppliers who could potentially provide a maintenance service, they are unlikely to be able to offer the same expert knowledge, software support or replacement original equipment parts at a competitive cost required for an effective support contract at this point in time.
In addition, the contract will also include a small volume of vial consumables that are compatible with the Tandem MS. Over the five years, it is estimated that this will be in the region of 15k.
Due to this, the Health Board is intending to agree a five year comprehensive service support contract with Waters Limited and is applying a 10 day standstill period whilst informing the market of its intentions.
