Primary Care Services are not in a position to undertake a tender exercise as it has been instructed by their landlord that they must award to a known supplier as their on strict timescales to adhere to.

The procurement falls outside the scope of application of the Directive
Explanation
NHS Wales Shared Services Procurement department on behalf of Primary Care Services intend to award a single works contract to enable lighting works to take place at new premises, as to which a lease has been agreed.
The delivery of the timely requirements is an essential requirement to enable the transfer of premises to take place to avoid dual running costs, which have not been forecasted.
The works can only be carried out by the supplier contracted to the landlord to ensure the tight deadlines are met. The known supplier Little Mill is aware of the sites plans to ensure a robust infrastructure is put into place that meets with the landlords’ requirements.
Due to the unforeseen lighting requirements and the tight timescales required for the new lease to commence, further delays cannot be absorbed as the exit plan of the existing premises must be met due to Reinforced Autoclaved Aerated Concrete RAAC in the Roof.
